  Jagan’s DA case - New ‘bench mark?’

The disproportionate assets case of Y S Jaganmohan Reddy is set to become a classic case – one among many such cases making headlines. It is extraordinarily unique case with tremendous political overtones. It may set a precedent for many more heads under scanner. For example, investigation also into disproportionate assets of Robert Vadhera, the prince charming of Priyanka Gandhi, may become a prospect should people reject Congress Party in 2014.

Ironic it is that the Congress Party regional Satraps like Vilasrao Deshmukh, Ashok Chavan, Shinde, Suresh Kalmadi, late YSR and so on are under scanner in various scams. But the real culprits or beneficiaries cannot get away with it – the Congress High Command represented by Sonia Gandhi and her coterie. People are no more fools. They are fully aware that collections or “mamools” are extorted from the people in the name of Congress High Command for fighting elections.

At each level, the agent like Chief Minister, Ministers and selected MPs carry out their obligations to High Command and keep a portion of the collection for their personal use or misuse!

Following such a well-known practices by almost all political parties without exception, was evident from the prosecution of former president of BJP, Bangaru Laxman. The BJP president was caught red handed accepting ‘bribe’ by Tehelka correspondents in a sting operation. Hence, many more skeletons likely to tumble out from the cupboards of the high and mighty of the land. It will be beyond the capability and capacity of the CBI – a tool of whichever party is in power – to bring out all facts into public domain. Reason; in a bid for survival and to get plum posts, they choose to play to the tunes of their political masters.

Since KVP, enjoyed the privileged position of political advisor (Cabinet position) to late Dr YSR, he is privy to all the transactions made to the Congress High Command. His acquired assets since 2004, also needs to be investigated. Why is he not being investigated?

More important, KVP was the main brain behind and conduit to the Congress High Command. If investigated by an independent authority under the direct supervision of Supreme Court, the lid of Congress High Command’s will be blow off beyond an average Indian’s imagination, leave alone Andhrites.

In retrospect, even the BJP, the TDP or many other parties cannot adopt ‘holier than thou” posture. All of them have many skeletons in their cupboards. They too will tumble out sooner than later.
Even Jagan is most likely in the know of all the details of various transactions. If he too is investigated by independent authority under the direct supervision of the Supreme Court, all alike will be exposed.

The Enforcement Directorate as well the CBI may have gained tremendous insights in the Satyam-type fraud. Such a fraud could not have happened for over a decade without connivance of the political leaders and bureaucrats. Let none suffer from any illusions on the above count. Even now, such frauds are happening all around on daily basis.
If the CBI is earnest and honest, they can expose all the murky deals happening in a system with gaping loopholes in laws, rules and procedures and dysfunctioning of three pillars of Indian Constitution like the Executive, Legislature and the Judiciary. If the CBI fails to fix the “Onus of Responsibility” in Jagan’s case thereby making him a sacrificial lamb to foist the “Prince in Waiting” to lead the Congress Party and India, woe be to posterity of modern India.


If one has to go by Rule Book and ‘Law of the Land’, then no investigating agency on the earth can establish conclusive evidence to nail Jagan directly in the so called disproportionate assets case. Even if one has to consider ‘exchange of money’ in the form of ‘quid pro quo’ happen, still Jagan cannot be held solely responsible by any Law Book. Of course, unless and until the Council of Ministers of that day and the Executive turn as approvers and claim that they had made allotments to those Corporates which overenthusiastically invested in Jagan’s firms as ‘quid pro quo.’

How to establish this? Even if the entire Cabinet colleagues of late YSR and his Executive staff today stand in unison and admit to the Court that they had done the crime at the behest of their leader, can the Courts dare take cognizance of such claims against a dead person and slap ‘death sentence’ on his son Jagan, who claims to have never lived or seen or in contact with any of his father’s cabinet colleagues and officials, to prove that he is guilty?

I, as an analyst subscribe to this view point and sincerely feel that the Jagan’s case indeed sets a new goal post for the day-to-day functioning of the Cabinet of the day or the Executive. Hereafter, both these Constitutional pillars have to be more than cautious in taking whatever decisions they have to. Am also a firm believer that the Jagan’s DA case will also throw up new challenges to modern day politician as well bureaucrat to be more responsible while discharging their duties.

The Jagan’s case is a classic case to that effect, even to judiciary, which too confused how to move ahead with the half-baked and fabricated facts put before them by the so called premier investigative agency – CBI.
Y S Rajasekhara Reddy, who emerged as a ‘mass leader’ after his 1800 km padayatra just before the 2004 general elections and established himself as either ‘modern day monarch’ or ‘messaiah of poor’, called shots, instead of his party high command from New Delhi. Thus far, he even changed the perception of even Congress party’s arch rival Telugu Desam party to reverse its allegation during YSR tenure blaming the New Delhi for succumbing to YSR’s pressure. In fact, the TDP came to exist and consolidate its ground in the state as major party for its opposition to New Delhi calling shots or governing the state from there.

But, the same party which fought all through for Telugu’s pride and consolidated its position as most powerful regional party on so called Telugu pride today backtracked to support the same Delhi rulers administering. Can there be anything more ridiculous than this of TDP?
Whether the CBI can provide conclusive evidence to prove Jagan’s guilty in alleged ‘quid pro quo’ arrangement to amass disproportionate assets or not, the possible twists and turns that bound to take in coming days by ‘widening the scope of the case’ by many more arrests of erstwhile YSR cabinet colleagues and civil servants, who were responsible for issuance of 26 GOs certainly set new bench marks for the coming rulers or administrators. That’s for sure!
