Suspension of CBI judge by AP HC, incredible action

(By Vijay Kumar)

Suspension of Special CBI Court judge Pattabhirama Rao by the AP High Court for allegedly accepting Rs 5 crore bribe from Gali Janardhan Reddy, accused in multi-crore scam and former Karnataka minister, is a welcome move. This move indeed shall help rejuvenate “faith’ in judiciary system at large.

In the recent past, judiciary too had come under scanner due to surprising and shocking verdicts delivered in some cases. The best example to cite may be of Janata Party MP Subramaniam Swamy’s case against P Chidambaram in 2-G scam. Swamy, who produced clinching evidence to nail lies of Chidambaram as far as his ‘direct’ or ‘indirect’ involvement in the scam (read allotment process of telecom licenses) as Finance Minister concerned, failed to convince the concerned Magistrate and his ‘judgment’ stunned the nation. So was in case of the Army Chief V K Singh’s date of birth controversy. On both occasions, it was your website that had expressed apprehension over these two judgments as responsible media.

Apart from these, there are umpteen exmpales where judicial officers, including the former Chief Justice of India, had to face serious allegations, resulting in growing suspicion over the very functioning of our judicial system.

If the former prime minister Indira Gandhi had been accused of introducing, if not promoting criminals in body politics, then similar accusations persist against former Andhra Pradesh chief minister and TDP chief, Nara Chandrababu Naidu, for corrupting officials of all constitutional pillars - legislature, executive and judiciary, besides the so called fourth estate, that's media.

During his nine year tenure how Naidu managed to post 'hand-picked' few as judges in state High Court or 'grease the palms of those Chief Justices, through unacceptable means. Editor of an English daily had also these facts out in an article, not so long ago.
But, in suspending the CBI judge, the Andhra Pradesh High Court decision to act decisively is highly laudable. And every Indian citizen who still has faith in judiciary, should welcome it such judicial verdict delivered against one of its breed.

However, those who influenced even judges prior to delivery of judgment should be severely punished. One can cite quite few examples. For example, the Vijayawada Congress MP, Lagadapati Rajagopal, who is also a well-known entrepreneur, is one person who has been hogging limelight by his indiscretions. To repose faith among those invested in his Lanco Hills project in Hyderabad, Rajagopal reportedly sent ‘sms’ stating that the court judgment is bound to come in their favor.

In fact, the land on which the Lanco Hills project was taken up belongs to Wakf Board land and the AP High Court twice had also dismissed the MP promoted Construction Company petitions (arguments). The erstwhile TDP government headed by N Chandrababu Naidu, who allotted the land to Lanco Group, had to cancel the land agreement deal honoring the HC directions.

Due to his political clout, the Congress MP hoodwinked then Congress Chief Minister late Y S Rajasekhara Reddy and got it re-allotted. Once again, the HC delivered the same verdict. Following it, the MP moved the Supreme Court. For whatever reason the apex court reversed the AP High Court judgment and favored Lanco Group! Whom the Cong MP has influenced now? - the apex court judge? or, the state government to put up weak defense? With such a murky background, how one can buy or appreciate Lagadapati Rajagopal and uphold his virtues?

So far, the nation had seen the people representing the so called pillars of our Constitution like Legislature and Executive and now the third pillar – that’s judiciary – though does not seem to be above board – to establish how dangerous Indian democracy is traversing.

The ‘greed’ of average Indian has grown enormously in the recent past and occupied the front seat,
while ‘honesty’ pushed to the back-seat! That’s the tragedy of a nation of 120 billion which many boasts of emerging ‘super power.’

But, ironically the fact remains; "The bubbling dream of millions Indians indeed turning out to be a flat soda!!
